In May 2021, Alan Bechaz, Racher Du, Will Cailes and Thomas Spiteri interviewed Sandra Leonie Field for UPJA’s Conversations from the Region. A series of discussions that invites philosophers from or based in Australasia to share their student and academic experiences. The segment looks into what inspires people to study philosophy, how they pursue their philosophical interests, and gives our audiences a better idea of philosophy as an undergraduate.

Performative accounts of personhood argue that group agents are persons, fit to be held responsible within the social sphere. Nonetheless, these accounts want to retain a moral distinction between group and individual persons. That: Group-persons can be responsible for their actions qua persons, but that group-persons might nonetheless not have rights equivalent to those of human persons. I present an argument which makes sense of this disanalogy, without recourse to normative claims or additional ontological commitments. In this paper, I put the claim that sensitivity is a necessary condition for knowledge under pressure, by considering its applicability with regard to testimonially-formed beliefs. Building on, and departing from, Goldberg, I positively draw out how we might understand the required sensitivity as a social interaction between speaker and hearer in testimonial cases. In doing so however, I identify a concern which places the whole notion of testimonial sensitivity in potential jeopardy: the problem of the reliable liar. I find (...) an apparently paradoxical inverse relationship between better-differentiating methods that fulfil sensitivity conditions, and being able to have sensitive beliefs with regard to specific instances of testimony. After examining potential resolutions, I conclude that only a focus on minimally realising the problem, rather than “solving” it, will enable us to retain sensitivity as a necessary condition for testimonial-knowledge. This article offers a distinctive way of grounding the regulative duties held by social media companies (SMCs). One function of the democratic state is to provide what we term the right to democratic epistemic participation within the public sphere. But social media has transformed our public sphere, such that SMCs now facilitate citizens’ right to democratic epistemic participation and do so on a scale that was previously impossible. We argue that this role of SMCs in expanding the scope of what (...) counts as fair democratic epistemic participation, and in becoming the providers of access to the digital public sphere, brings with it duties of regulation. ABSTRACT Genevieve Lloyd argues that when we follow Spinoza in understanding reason as a part of nature, we gain new insights into the human condition. Specifically, we gain a new political insight: we should respond to cultural difference with a pluralist ethos. This is because there is no pure universal reason; human minds find their reason shaped differently by their various embodied social contexts. Furthermore, we can use the resources of the imagination to bring this ethos about. In my response, (...) I offer a friendly challenge to Lloyd’s characterisation of the lessons of Spinoza’s philosophy. I argue that Lloyd’s Spinoza remains excessively unpolitical, even in the moment that he is brought to bear on contemporary politics. An unpluralistic attitude may well be rationally inferior, but is it really explained by insufficient or inappropriate imagination? To the contrary, a properly Spinozist account of reason must include an account of the concrete determinants of reason’s imperfect realisation in the world. In Spinoza’s own oeuvre, this is carried out through an ever-increasing—and ever more sociological—interest in the political structures within which individual reason flourishes or withers. (shrink)

According to a recent interpretive orthodoxy, Spinoza is a profoundly democratic theorist of state authority. I reject this orthodoxy. To be sure, for Spinoza, a political order succeeds in proportion as it harnesses the power of the people within it. However, Spinoza shows that political inclusion is only one possible strategy to this end; equally if not more useful is political exclusion, so long as it maintains what I call the depoliticised acquiescence of those excluded.

This book offers a detailed study of the political philosophies of Thomas Hobbes and Benedict de Spinoza, focussing on their concept of power as potentia, concrete power, rather than power as potestas, authorised power. The focus on power as potentia generates a new conception of popular power. Radical democrats–whether drawing on Hobbes's 'sleeping sovereign' or on Spinoza's 'multitude'–understand popular power as something that transcends ordinary institutional politics, as for instance popular plebsites or mass movements. However, the book argues that these (...) understandings reflect a residual scholasticism which Hobbes and Spinoza ultimately repudiate. Instead, on the book's revisionist conception, a political phenomenon should be said to express popular power when it is both popular (it eliminates oligarchy and encompasses the whole polity), and also powerful (it robustly determines political and social outcomes). Two possible institutional forms that this popular power might take are distinguished: Hobbesian repressive egalitarianism, or Spinozist civic strengthening. But despite divergent institutional proposals, the book argues that both Hobbes and Spinoza share the conviction that there is nothing spontaneously egalitarian or good about human collective existence. From this point of view, the book accuses radical democrats of pernicious romanticism; the slow, meticulous work of organizational design and maintenance is the true centre of popular power. This study asserts that W.V.O. Quine’s eliminative philosophical gaze into mereological composition affects inevitably his interpretations of composition theories of ontology. To investigate Quine’s property monism from the account of modal eliminativism, I applied to his solution for the paradoxes of de re modalities’ . Because of its vital role to figure out how dispositions are encountered by Quine, it was significantly noted that the realm of de re modalities doesn’t include contingent and impossible inferences about things. Therefore, for him, (...) all the intrinsic forces and elements of entities such as powers and causal or teleological dispositions for ontology demand to be seen necessarily as bound variables from a monist perspective. Although his denial of analyticity and the elimination of dispositional field of ontology, S. Mumford criticizes the monist perspective of Quine’s paradoxical approach to superveniences. Because superveniences create problems while determining type-type identities from a monist mereological perspective. It is observed that Quine faces with a reduction again in terms of his dispositional monism despite his critiques to repulse vagueness from the ontology in his well-known article Two Dogmas of Empiricism. -/- . In this chapter, the author articulates two Hobbesian models of interpersonal power relations that can be used to understand gender relations: what he will call the dominion model and the deference model. Hobbes himself analyses the relation between men and women through the dominion model. The author lays out Hobbes's model of interpersonal power relations as dominion, including his application of the model to the case of gender relations. The centerpiece of Hobbes's method is his “state of nature” thought experiment. (...) Hobbes's analysis is radical insofar as he understands familial relations according to the general model of interpersonal relations just outlined, without any reference to sui generis principles. The author indicates some shortcomings of the dominion model for grasping contemporary social life. The much‐celebrated social contract between equal male citizens is quietly underpinned by the sexual contract, a contract of domination between men and women. (shrink)

The Surprise Exam Paradox is well-known: a teacher announces that there will be a surprise exam the following week; the students argue by an intuitively sound reasoning that this is impossible; and yet they can be surprised by the teacher. We suggest that a solution can be found scattered in the literature, in part anticipated by Wright and Sudbury, informally developed by Sorensen, and more recently discussed, and dismissed, by Williamson. In a nutshell, the solution consists in realising that the (...) teacher's announcement is a blindspot that can only be known if the week is at least 2 days long. Along the way, we criticise Williamson's own treatment of the paradox. In Williamson's view, the Surprise is similar to the Paradox of the Glimpse and, because of their similarities, both these paradoxes ought to receive a uniform treatment-one that involves locating an illicit application of the KK Principle. We argue that there's no deep analogy between the Surprise and the Glimpse and that, even if there were, the Surprise reasoning reaches a paradoxical conclusion before the KK Principle is used. Rather, in both the Surprise and the Glimpse, the blame should be put on other epistemic principles-respectively, a knowledge retention and a margin for error principle. (shrink)

Thomas Hobbes has been hailed as the philosopher of power par excellence; however, I demonstrate that Hobbes’s conceptualization of political power is not stable across his texts. Once the distinction is made between the authorized and the effective power of the sovereign, it is no longer sufficient simply to defend a doctrine of the authorized power of the sovereign; such (...) a doctrine must be robustly complemented by an account of how the effective power commensurate to this authority might be achieved. Nor is this straightforward: for effective political power can fluctuate, sometimes severely. In this light, the prevalent juridical reading of Hobbes’s political philosophy is inadequate. (shrink)

Political protesters often don’t play by the rules. Think of the Occupy Movement, which brought lower Manhattan to a standstill in 2011 under the slogan, “We are the 99%”. Closer to home, think of the refugee activists who assisted a breakout from South Australia’s Woomera detention centre in 2002. Both are examples of contentious politics, or forms of political engagement outside the institutional channels of political decision-making. The democratic credentials of contentious politics are highly ambivalent. On the one hand, contentious (...) politics appears to have insufficient respect for democratic decision. Protesters are often forceful, uncivil and rowdy, aiming to disproportionately influence policy. But shouldn’t proposals be put forward with civility through the proper channels? And shouldn’t their proponents accept with good grace if they are democratically rebuffed? A closer look at the history of political thought can provide us with the framework to assess the case for and against the democratic reasonableness of contentious politics. (shrink)

Skeptical theists are seeking for some reasonable solutions to the evidential problem of evil. One of the most fundamental responses of skeptical theism is that the concept of “gratuitous evil”, which cannot be a proof of the absence of God. Therefore, it is not the existence of God that skeptical theism suspects. Instead, skeptical theism contemplates whether the evil in the world really has a “gratuitous” basis. This paper focuses on Peter van Inwagen's “no-minimum claim”. No-minimum claim” stands in opposition (...) to the views that assume that God minimizes the evils that exist in the world in order to achieve justice. “No-minimum claim” acknowledges that these evils still have enormous amounts to people. Thus “no-minimum claim” suggests that the evils experienced in the world are incompatible with the “best of all possible worlds” views or the other explanations of classical theodicy. According to the “no minimum claim”, the reason why the amount of evil in the world still seems so high may be God’s deliberate calculations in effecting the distribution of these evils. In order to reach these calculations, it is not necessary for the amount of evil that God allowed to reflect on the world to be perfectly manifested at the minimum level. The purpose of this paper is to consider the skeptical theism approach within the framework of Peter van Inwagen's “no-minimum claim” and to limit his arguments to an alternative approach to skeptic theism. Our claim is that such view coincides with skeptical theism, but the “no- minimum claim” still has some ambiguities at the point of the limits of evil. From this, we can conclude that the “no minimum claim” has received many objections in the skeptical theism literature and these objections are justified at certain points. (shrink)

The social group named after the various discourses of individuals who define themselves as the champions of the men's rights movement on social media is called the “Manosphere” in the literature. “Oneitis”, a concept in the jargon of the manosphere, basically refers to a disease state used to represent situations in which a man invests excessive attention in a woman who is not equally interested in him. For the Red Pill movement, the most influential group in the manosphere, oneitis is (...) criticized as a pattern of behavior that should be avoided by men. Red Pill philosophy is also often associated with alt-right ideologies due to its anti-feminist and pragmatic views. Red Pill thought can therefore often be seen as contrasting with Woke Culture, a counter-cultural movement that advocates the constant practice of vigilance against political discourses that oppress certain social groups through structural mechanisms of oppression such as racism, anti-blackness, and anti-feminism. In this paper, I argue that the concept of oneitis, when suspended from its anti-feminist and commodifying contexts, can in fact be read as a critique of a conception of love that is deeply rooted in traditional gender roles that are often criticized from perspectives such as feminism or Woke Culture. When the liberation from oneitis is considered independently of the manosphere framework, it can be read as a critique of coercive social practices in terms of romantic relationships. (shrink)

It is common to assimilate Marx’s and Spinoza’s conceptions of democracy. In this chapter, I assess the relation between Marx’s early idea of “true democracy” and Spinozist democracy, both the historical influence and the theoretical affinity. Drawing on Marx’s student notebooks on Spinoza’s Theological-Political Treatise, I show there was a historical influence. However, at the theoretical level, I argue that a sharp distinction must be drawn. Philosophically, Spinoza’s commitment to understanding politics through real concrete powers does not support with Marx’s (...) anti-institutional conception of true democracy. And as a matter of social theory, the gap between civil society and the state which so troubles Marx is a development of modernity that has not entered Spinoza's premodern field of view. Marx’s true democracy was also influenced by his study of Rousseau, and theoretically, it is just as close if not closer to Rousseau as to Spinoza. (shrink)

In the ancient Greek world, the concept of 'miasma,' which becomes permanent and has the potential to grow over time due to evil acts such as murder committed in the city, is a concept frequently referred to in many classical tragedies. To the extent that miasma has a bad connotation due to its nature and is a situation that occurs due to evil actions, it can be considered together with the philosophical problem of evil. In this study, we aim to (...) examine the concept of miasma by focusing on the characters in La Jauría, one of the most prominent films of recent South American cinema, rather than a purely conceptual analysis of the concept. Filmed in the jungles of Colombia and directed by Colombian director Andrés Ramírez Pulido, the 2022 film La Jauría is a psychological drama that focuses on the lives of young people involved in crime. The tragic story of Eliu, the protagonist of the film, which takes place mainly in a prison specially designed to rehabilitate inmates, seems to us to be a very suitable focal point for examining the concepts of miasma, catharsis, and ecstasy, which are frequently referred to in ancient Greek tragedy. To do so, we will first address the various contexts in which miasma has been used historically, considering the flow of events in the movie La Jauría. Then, we will look at the relationship of the concept of miasma with the problem of evil. Finally, we will discuss the possibilities of the concept of purification, which is seen as a kind of antidote to miasma. (shrink)

Integrity is often conceived as a heroic ideal: the person of integrity sticks to what they believe is right, regardless of the consequences. In this article, I defend a conception of ordinary integrity, for people who either do not desire or are unable to be moral martyrs. Drawing on the writings of seventeenth century thinker Huang Zongxi, I propose refocussing attention away from an abstract ideal of integrity, to instead consider the institutional conditions whereby it is made safe not to (...) be servile. The European Hobbes Society Online Colloquium featured my book, Potentia: Hobbes and Spinoza on Power and Popular Politics. This is a précis of the book.

Jean-Luc Nancy takes the concept of "essence" in order to indicate its drawbacks on the singularity of being. The concept of essence is not a universal and necessary origin, but contingent and historical meanings for Nancy. This historicity in meaning leads Nancy to question the concept of the individual and the rules of the social/public sphere allocated through individuality. Nancy's argument on the ontological environment of finite beings aims to highlight those beings are mixed singular, not belonging to a universal (...) unit. This allows us to discover that being is singular and also singular-plural to the extent that it is with the other. Thus, essential historical concepts invalidate individual or social organizations at this point. Nancy calls this “finitude” which is the only transcendental concept that makes possible the “being with” (Mitsein). It is possible to think that finitude is the only property to make a community of singularities rather than ready-made concepts of social sciences. I argue that this position is methodological for an alternative socio-ontology. (shrink)

The European Hobbes Society Online Colloquium featured my book, Potentia: Hobbes and Spinoza on Power and Popular Politics, with critical commentaries from Alissa MacMillan, Chris Holman, and Justin Steinberg. This is my response to their commentaries.

Students often have difficulty connecting theoretical and text-based scholarship to the real world. When teaching in Asia, this disconnection is exacerbated by the European/American focus of many canonical texts, whereas students' own experiences are primarily Asian. However, in my discipline of political philosophy, this problem receives little recognition nor is it comprehensively addressed. In this paper, I propose that the problem must be taken seriously, and I share my own experiences with a novel pedagogical strategy which might offer a possible (...) path forward. Recent scholarship has championed an active learning approach, where students engage in their own research, and deliver outward-facing products that have a meaning and purpose beyond the confines of the student-professor relationship. In this spirit, I have put into practice a strategy of course design, where active learning is used to overcome students' disconnection with the course content. In particular, as a major component of course assessment, students are required to write an 'opinion piece', which is then showcased on a public website. The opinion piece must address a real-world issue which the student himself or herself selects and deems important; furthermore, it must build on the theoretical tools of the course and be written in a style which makes it accessible to a wider audience. I discuss the implementation of this strategy in two political philosophy courses, including strategies to avoid 'dumbing down' and ‘diluting’ the process of critical thinking. While no formal analysis of impact of the strategy on learning outcomes has been conducted, an anonymous pedagogical survey has yielded an overwhelmingly positive response for students' self-reported perceptions of the curricular innovations. Is there something about the deep logic of democracy that destines it to succeed in the world? Democracy, the form of politics that includes everyone as equals – does it perhaps suit human nature better than the alternatives? After all, surely any person who is excluded from the decision-making in a society will be more liable to rise up against it. From ancient thinkers like Seneca to contemporary thinkers like Francis Fukuyama, we can see some version of this line of (...) thought. Seneca thought that tyrannies could never last long; Fukuyama famously argued that liberal democracy is the end of history. I want to focus instead on the person credited with giving the most direct and uncompromising statement of this thought: Benedict de Spinoza. However, in this article, I argue to the contrary that Spinoza’s view of aristocracy should give pause to radical democrats. He does not see a historical movement towards democracy, nor does he see the superiority of democracy as written into human nature. (shrink)

The rapid pace of technological advancements offers an essential field of research for a deeper understanding of man’s relationship with artifacts of her design. These artifacts designed by humans can have various mental and physical effects on their users. The human interaction with the artifact is not passive; on the contrary, it exhibits a potential that reveals the inner dispositions of human beings and makes them open to new creations. In this article, we will examine the impact of technology on (...) human life through the dispositional compatibilism perspective of the contemporary philosopher Kadri Vihvelin, arguing for a system of metaphysics in which ontology of properties depend on dispositions. In this context, the emerging phenomenon of dispositional compatibilism opens the door to developing new philosophical ideas for evaluating the concepts of compatibilism and freedom in the context of technology. Thus, it is emphasized that although technological devices shape human life, new and unforeseen powers may emerge due to human-artifact interaction. This article will examine the idea of dispositional compatibilism by specifically considering human interaction with text-based AI applications. The ability of AI to collaborate with human thought patterns is a meaningful example of the observation of dispositional compatibilism. In conclusion, the article aims to address the effects of technology on human freedom by approaching the human-artifact relationship from a dispositional perspective. It also aims to defend the claim that technological artifacts can positively contribute to human freedom from the perspective of dispositional compatibilism. (shrink)

I argue that, although Aristotle himself does not say it in so many words, the Phaedrus has a deep influence on the three books of Aristotle’s Rhetoric. I also show that this influence is not only negative, as some scholars believe, but that Aristotle draws and expands on some of the results and propositions of the Phaedrus. After demonstrating how influential the Phaedrus is for the Rhetoric, I return in my conclusion to the difference between the two works.

Are words like ‘woman’ or ‘man’ sex terms that we use to talk about biological features of individuals? Are they gender terms that we use to talk about non-biological features e.g. social roles? Contextualists answer both questions affirmatively, arguing that these terms concern biological or non-biological features depending on context. I argue that a recent version of contextualism from Jennifer Saul that Esa Diaz-Leon develops doesn't exhibit the right kind of flexibility to capture our theoretical intuitions or moral and political (...) practices concerning our uses of these words. I then float the view that terms like 'woman' or 'man' are polysemous, arguing that it makes better sense of the significance of some forms of criticisms of mainstream gender ideology. (shrink)

At the centre of Powers' (2019) China and England is an extraordinary forgotten episode in the history of political ideas. There was a time when English radicals critiqued the corruption and injustice of the English political system by contrasting it with the superior example of China. There was a time when they advocated adopting a Chinese conceptual framework for thinking about politics. So dominant and prevalent was the English radicals' use of this framework, that their opponents took to dismissing their (...) points as 'the argument from the Chinese'. In my review of Powers' book, I welcome the profound reconfiguration of our political understandings that knowledge of this historical episode brings. However, I question Powers' framing presumption that the generic problems of any complex society lead to convergence on a single master political value of 'social justice'. Surely there are deep and enduring differences amongst thinkers of political value, even within a single society, let alone across different societies. Taking this point seriously would challenge the simple linear directionality of Powers' story of moral and political progress. (shrink)

Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

In this review, I discuss the justifications for focussing on Hobbes's On the Citizen (De Cive), the middle recension of his political philosophy, separately from his better known Leviathan. I provide an overview of the collection's chapter contents, and I close by calling for further research regarding the impact of this text on later European political philosophy (such as Spinoza, Rousseau, Kant).

Experimental philosophers have gathered impressive evidence for the surprising conclusion that philosophers' intuitions are out of step with those of the folk. As a result, many argue that philosophers' intuitions are unreliable. Focusing on the Knobe Effect, a leading finding of experimental philosophy, we defend traditional philosophy against this conclusion. Our key premise relies on experiments we conducted which indicate that judgments of the folk elicited under higher quality cognitive or epistemic conditions are more likely to resemble those of the (...) philosopher. We end by showing how our experimental findings can help us better understand the Knobe Effect. (shrink)

In this review of Abizadeh's book, I question whether identifying a human 'capacity for reason' really resolves the problems with Hobbes's philosophy's distinctive combination of mechanistic materialism and moral normativity.

Amongst invertebrates, molluscs show great variability in their nervous system ranging from primitive arrangement in Chitons to the complex mass of fused ganglia forming the ‘brain’ of cephalopods. Most of the effector organs used for pharmacological or physiological experiments. The neurosecretory cells (NSCs) with their combination of neuronal and glandular capabilities are perfectly suited to translate a neuronal input into the hormonal output best suited to long-term process. In this capacity, the NSCs may produce hormones, which act directly upon the (...) peripheral target or it may exert its effect indirectly by influencing the activity of other non-neural, endocrine organs. Neurosecretory cells have been detected in the cerebral, pedal and visceral ganglia of Lamellidens corrianus. The distribution and biology of freshwater bivalve like Lamellidens corrianus is influenced by local ecological factors (like temperature, pH, inorganic salts, type of soil etc.), water flow system and presence of micro-organisms, teleost fishes and seasonal variations in these parameters. Nitrogenous excretory changes which include ammonia in these molluscs is also influenced by these local ecological factors in which temperature is plays very crucial role. It is well known fact that the high stress conditions during drought or severe winter conditions have been conquered by several lineage of gastropods and sand bivalves and their ability to enter the resistant or dormant stages (low food) protein catabolism increased. Present investigation deals with the oxygen consumption and ammonia excretion ratio of these freshwater pelecypode Lamellidens corrianus. Study on Lemellidens corrianus directed in understanding the different behavioral and physiological aspects after cerebral ganglia removal and injection of their extracts revealed significant changes during summer (April-May). Upon doing something generous for someone with whom you are close, some kind of reciprocity may be appropriate. But it often seems wrong to actually request reciprocity. This chapter explores the wrongness in making these requests, and why they can nevertheless appear appropriate. After considering several explanations for the wrongness at issue (involving, e.g. distinguishing oughts from obligation, the suberogatory, imperfect duties, and gift-giving norms), a novel proposal is advanced. The requests are disrespectful; they express that their agent insufficiently trusts (...) the hearer to recognize their own reasons to reciprocate, and the close relationship between them morally requires this kind of trust. This proposal is articulated and situated in the recent discussion of the normativity of requests. The chapter concludes by explaining how these requests may appear appropriate. Agents in these relationships often have standing to make requests, though the standing is lacking in these particular cases. (shrink)

Epistemic humility, a cornerstone of philosophical and scientific inquiry, emphasizes the recognition of human fallibility and the provisional nature of knowledge. This concept contrasts with epistemic arrogance by promoting a humble acknowledgment of the limits of understanding and a willingness to revise beliefs in light of new evidence. Historical perspectives, from Socrates' dialogues to Descartes' methodological doubt and Hume's critique of induction, illustrate the evolution of epistemic humility as a critical component of skeptical thought. Philosophical reflections on intellectual virtues, such (...) as curiosity and open-mindedness, underscore the importance of embracing uncertainty in the pursuit of truth. Contemporary discourse on epistemic humility addresses its role in scientific progress, public policy, and societal dialogue, highlighting its potential to foster intellectual integrity and informed decision-making amidst complexity and uncertainty. Political legitimacy is best understood as one type of a broader notion, which I call institutional legitimacy. An institution is legitimate in my sense when it has the right to function. The right to function correlates to a duty of non-interference. Understanding legitimacy in this way favorably contrasts with legitimacy understood in the traditional way, as the right to rule correlating to a duty of obedience. It helps unify our discourses of legitimacy across a wider range of practices, especially including (...) the many evaluations we increasingly make of international institutions of various sorts, but also including domestic institutions. Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience. The notion of homosexuality in Sub-Saharan African countries has been demonized and rejected based on the assumption that it is both unnatural and alien to African customs and practices. As a result, LGBTQ individuals continue to face stigmatization and discrimination which often translates into verbal, physical and sexual violence. Nevertheless, gender progressive movements such as the Matrix Support Group, have made progress in demystifying misconceptions about LGBTQ community as an attempt to end homophobic attitudes and to negotiate the acceptance of (...) these sexual minorities in African societies. Despite such efforts and developments, heterosexual individuals in Lesotho continue to treat sexual minorities with hostility due to their ignorance about sex, sexuality and gender, thus fuelling hatred towards members of the LGBTQ community. Research has mainly focused on the negative effects of discrimination and stigmatization of homosexuals but overlooked the fundamental cause of homophobia in Lesotho. By employing the content analysis method, this paper provides a systematic analysis of Lesotho’s patriarchal system and its bearing on sexual minorities by exploring the intersectionality of homosexuality, patriarchy, and homophobia. It argues that the constant use of derogatory terms which instigate hate-crimes and discrimination of sexual minorities not only hinders a positive change of attitude but prevents a shift from misguided conceptions about homosexuality. This paper concludes that the revision of power relations and legal interventions aimed at prohibiting stigmatization and violence against homosexuals are imperative in ensuring the protection and recognition of LGBTQ people’s rights in Lesotho. I argue that legitimacy discourses serve a gatekeeping function. They give practitioners telic standards for riding herd on social practices, ensuring that minimally acceptable versions of the practice are implemented. Such a function is a necessary part of implementing formalized social practices, especially including law. This gatekeeping account shows that political philosophers have misunderstood legitimacy; it is not secondary to justice and only necessary because we cannot agree about justice. Instead, it is a necessary feature of actual human social practices, (...) which must be implemented via practitioners' discretion in changing contexts. (shrink)

The essays collected in this special issue explore what legitimacy means for actors and institutions that do not function like traditional states but nevertheless wield significant power in the global realm. They are connected by the idea that the specific purposes of non-state actors and the contexts in which they operate shape what it means for them to be legitimate and so shape the standards of justification that they have to meet. In this introduction, we develop this guiding methodology further (...) and show how the special issue’s individual contributions apply it to their cases. In the first section, we provide a sketch of our purpose-dependent theory of legitimacy beyond the state. We then highlight two features of the institutional context beyond the state that set it apart from the domestic case: problems of feasibility and the structure of international law. (shrink)

Ethicists struggle to take reductive views seriously. They also have trouble conceiving of some supervenience failures. Understanding why provides further evidence for a kind of hybrid view of normative concept use.

Institutions undertake a huge variety of constitutive purposes. One of the roles of legitimacy is to protect and promote an institution’s pursuit of its purpose; state legitimacy is generally understood as the right to rule, for example. When considering legitimacy beyond the state, we have to take account of how differences in purposes change legitimacy. I focus in particular on how differences in purpose matter for the stringency of the standards that an institution must meet in order to be legitimate. (...) An important characteristic of an institution’s purpose is its deontic status, i.e. whether it is morally impermissible, merely permissible, or mandatory. Although this matters, it does so in some non-obvious ways; the mere fact of a morally impermissible purpose is not necessarily delegitimating, for example. I also consider the problem of conflicting, multiple, and contested institutional purposes, and the different theoretical roles for institutional purpose. Understanding how differences in purpose matter for an institution’s legitimacy is one part of the broader project of theorizing institutional legitimacy in the many contexts beyond the traditional context of the state. A critical survey of various positions on the nature, use, possession, and analysis of normative concepts. We frame our treatment around G.E. Moore’s Open Question Argument, and the ways metaethicists have responded by departing from a Classical Theory of concepts. In addition to the Classical Theory, we discuss synthetic naturalism, noncognitivism (expressivist and inferentialist), prototype theory, network theory, and empirical linguistic approaches.
